Legalitas Negara dalam Rimba Gerilya: Studi tentang PDRI sebagai Penyelamat Kedaulatan Republik Indonesia

Abstract
Penelitian ini bertujuan untuk menganalisis peran Pemerintahan Darurat Republik Indonesia (PDRI) sebagai mekanisme legalitas negara dalam mempertahankan kedaulatan Republik Indonesia pada masa Agresi Militer Belanda II tahun 1948. Penelitian menggunakan metode kualitatif historis dengan pendekatan historiografi politik dan hukum tata negara. Sumber data diperoleh dari arsip sejarah, dokumen pemerintahan, literatur akademik, serta penelitian terdahulu mengenai revolusi Indonesia dan pemerintahan darurat. Teknik analisis data dilakukan melalui analisis historis kritis terhadap relasi antara legitimasi konstitusional, strategi gerilya, dan kontinuitas negara. Hasil penelitian menunjukkan bahwa PDRI berhasil mempertahankan eksistensi Republik Indonesia melalui pembentukan pemerintahan alternatif yang tetap memiliki legitimasi politik dan hukum. Legalitas PDRI dibangun melalui mandat konstitusional, koordinasi sipil-militer, jaringan komunikasi gerilya, dan pengakuan politik nasional maupun internasional. Penelitian ini menegaskan bahwa perang gerilya Indonesia juga merupakan perjuangan mempertahankan struktur legal negara modern dalam situasi krisis kedaulatan nasional.
